INSTRUCTOR AGREEMENT AND GUIDELINES

 

Please read this page carefully before submitting your instructor application to ConnectLAX.

 

Sports Recruits LLC, (collectively, “we”, “us”, or “ConnectSports”) provides the website known as ConnectLAX, as well as all services related to the website (the “Website”). In consideration for participation in the ConnectLAX service as an instructor, you agree that you have read, understand and agree to be bound by these Instructor Agreement and Guidelines (“Instructor Agreement and Guidelines” or “Agreement”), which define your use of ConnectLAX as an instructor and may be updated by us from time to time without notice to you. A copy of which can be found at the following link, ConnectLAX.com/instructoragreement. This Agreement is not intended to replace the Terms of Use, but include additional provisions specific to instructors. In the event of conflict between Terms of Use and this Agreement, the terms of this Agreement govern and control.

 

ConnectLAX helps individuals (“Clients”) who seek lacrosse training from instructors such as yourself.

 

These Instructor Agreement and Guidelines include important provisions about the responsibilities of instructors on ConnectLAX.

 

A Member shall be defined as a person or entity that has registered on the Website seeking services offered by ConnectLAX, or seeking to work with ConnectLAX as an instructor or otherwise create a public profile on the Website.

 

By using the Website, you signify that you have read, understand and agree to be bound by these Terms of Use (“Terms of Use” or “Agreement”), which may be updated by us from time to time without notice to you.

 

Instructor Status

 

This Agreement does not create an employee/employer relationship, partnership nor an agency between you and ConnectLAX. You do not have the authority to transact on behalf of ConnectLAX. Your statements and opinions are do not necessarily reflect the views of ConnectLAX, and you agree to make no act or representation to contradict this understanding.

 

Instructor Responsibilities

 

Instructors are responsible for providing individual or small group instruction services to Clients who book an instruction session on ConnectLAX. The instructor retains discretion as to the manner and means of conducting an instruction session consistent with the Terms of Use, which can be found on the following link, ConnectLAX.com/terms.

 

Instructors are responsible for actively managing their instruction availability in their account calendar and are strongly recommended to conduct the instruction session at the time booked by a Client. ConnectLAX reserves the exclusive right to dismiss instructors who consistently reschedule an Initial Session, defined as the first session a Client books with an instructor on ConnectLAX.

 

After the Initial Session, the instructor is free to determine his or her own cancellation policy. An instructor may not seek compensation from a Client for a missed or rescheduled Initial Session and may only seek compensation for the Initial Session once that session is completed. An instructor shall report any inaction or absence by any Client to ConnectLAX. You acknowledge and agree that ConnectLAX may or may not take any action as it, in its sole discretion, deems appropriate and has no obligation to compensate you or suspend, remove or terminate the Member account of a Client.

 

ConnectLAX is not a party to any agreement between Members, particularly instructors and Clients or any persons who receive individual and/or small group instruction. Such agreement is solely between and must be resolved directly by Members, including but not limited to payment due to an instructor.

 

Schedule and Availability

 

Instructors are free to set their own hours and instruction availability in their account calendar. After the Initial Session, instructors can directly schedule and book sessions with existing Clients through their account. It is the responsibility of the instructor to keep their calendar availability up to date to avoid duplicative bookings or the aforementioned need to reschedule an Initial Session.

 

Compensation and Payment

 

Instructors are free to determine their own hourly rate and collect 100% of the rate they charge directly from Clients. Instructors are responsible for agreeing to the method of payment with Clients prior to the instruction session. You acknowledge and agree that ConnectLAX is not responsible and has no obligation to collect payment from Clients.

 

Mobile Technology

 

Instructors are encouraged to provide Clients the opportunity to charge a credit, debit or charge card or financial institution account through a mobile payment processor for payment to an instructor for an Initial Session.

 

Non-exclusivity

 

Instructors are free to engage in and simultaneously perform any other employment while conducting instruction services with ConnectLAX. Instructors may advertise their services and skills to the general public.

 

Equipment and Supplies

 

Instructors will provide their own equipment and the supplies required to perform the instruction services booked by a Client. The instructor is responsible for notifying the Client of the equipment he or she needs to bring to the Initial Session at least twenty-four (24) hours prior to its scheduled start. We strongly recommend instructors establish ongoing equipment needs with their Clients and provide advance notice of at least an hour for any future sessions.

 

Travel and Facility Expenses

 

The instructor is solely responsible for all the costs and expenses related to their instruction services, including, but not limited to, transportations expenses, facility admission for the instructor and Client(s) if required, and administration or preparation expenses. We strongly recommend instructors consider these expenses in setting their hourly rate. ConnectLAX is not liable for any expenses incurred in the performance of instruction services.

 

Insurance, Benefits and Taxes

 

ConnectLAX provides no insurance of any kind and it is solely the instructor’s responsibility to comply with any relevant insurance requirements. You represent and acknowledge that you have purchased and are covered by workers’ compensation insurance for any injuries you may suffer in the course of the performance of instruction services to Clients. Additionally, ConnectLAX provides no benefits to instructors. Instructors are responsible for all federal, state, and/or local tax purposes. The instructor acknowledges and agrees that it is his or her responsibility to pay any applicable taxes.

 

Website Content

 

Notwithstanding anything to the contrary contained in the Terms of Use, the instructor acknowledges that content submitted by the instructor to the Website, including but not limited to, images, submitted videos, illustrations, profile information, documentation, community forums, reviews, endorsements, testimonials, blog entries and question responses by the instructor will be property of ConnectLAX. ConnectLAX may distribute or use such content at their sole discretion.

 

Background Checks

 

If you register as an instructor on ConnectLAX, you authorize ConnectLAX to verify the above representations and warranties by you and you acknowledge and agree that ConnectLAX shall have the right, but not the obligation, to verify such representations and warranties. You agree and understand that such verification may include, without limitation, conducting criminal background and motor vehicle records checks, sex offender registry screens, identification verifications and/or use of available public records (collectively, “Background Checks”). You consent to any collection, use or disclosure in order to accomplish such verification. You further agree that ConnectLAX may take such action as it, in its sole discretion, deems appropriate, including without limitation, suspending and/or terminating your use of the Website, should it determine that you have violated any representation or warranty.

 

Background Checks are from third party agencies; ConnectLAX does not endorse or make any representations or warranties regarding the reliability of such Background Checks or the accuracy, timeliness or completeness of any of its information. ConnectLAX does not independently verify information in the Background Checks. ConnectLAX is not responsible and expressly disclaims all responsibility and liability relating to or arising out of any Background Check, including but not limited to the receipt, misuse or disclosure of its results, and the services of any third party agencies.

 

You reserve the right to not grant or rescind permission for Background Checks, which may result in immediate removal from the Website. When third party agencies are used, you warrant that you will comply with the Fair Credit Reporting Act, 15 USC 1681 and any other applicable consumer reporting laws.

 

You understand and agree that ConnectLAX neither confirms nor denies the validity of information provided by Members and ConnectLAX does not verify that Members meet any or all of the conditions for eligibility. You understand and agree to make your own decisions and assessments about persons to engage and it is your sole responsibility to conduct any and all background or reference checks regarding other Members. Unless noted otherwise, you understand and agree that ConnectLAX does not conduct Background Checks or otherwise screen the Members registering on the Website in any way. You expressly assume all risk in connection with using the Website or when engaging the services or purchasing the goods of any Member or Website user, including but not limited to any online or offline interactions. As a result, we will not be liable for and expressly disclaim, any damages, direct, indirect and/or consequential, arising out of the use of this Website, including, without limitation, damages arising out of communicating and/or meeting other Members of the Website, or persons introduced to you via the Website. Such damages include, without limitation, physical damages, bodily injury and/or emotional distress or discomfort. You agree to take all necessary precautions, including without limitation, following the recommendations set forth in ConnectLAX’s Safety Tips, which can be found on the following link, ConnectLAX.com/safety, when interacting with other Members and Website users.

 

Confidentiality

 

Instructor acknowledges that, during the performance of instruction services, the instructor will have access to private, personal information relating to their Client’s identity and contact information. Instructor agrees to hold such information in the strictest confidence and not disclose it to any third parties including any person, firm or corporation or to use it except as necessary to provide instruction services to that Client. Instructor agrees that this duty is owed to ConnectLAX and any Client it receives aforementioned personal, private information from during the period of instruction services and thereafter.

 

Term and Assignment

 

The responsibilities and terms of this Agreement shall continue until terminated by either the instructor or ConnectLAX in accordance with this Agreement. The instructor or ConnectLAX can terminate this Agreement for any reason at any time. The instructor may not assign or transfer this Agreement without prior written consent from ConnectLAX.

 

Miscellaneous

 

The failure of ConnectLAX to exercise or enforce any right or provision of this Agreement shall not constitute a waiver of such right or provision. If any provision of this Agreement is found to be invalid, the parties nevertheless agree that the arbitrator or court should endeavor to give effect to the parties' intentions as reflected in the provision. The other provisions of this Agreement shall remain in full force and effect.
